Welcome to Portico. These Terms of Service ("Terms") govern your access to and use of Portico, including our website, applications, services, software, integrations, and related features (collectively, the "Service").

By accessing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. About Portico

Portico is a personal wellness and health-intelligence platform designed to help users understand patterns across areas such as sleep, activity, recovery, stress, nutrition, glucose, heart health, and other lifestyle or wellness signals.

Portico may integrate with third-party devices, applications, and data sources, including services such as Dexcom, Apple Health, Google Health Connect, Oura, and other wellness or health platforms, when authorized by the user.

2. Not Medical Advice

Portico is not a medical device and does not provide medical advice, diagnosis, treatment, cure, or prevention of any disease or medical condition.

The Service — including any data, scores, trends, or recommendations derived from connected devices such as continuous glucose monitors (CGMs), wearables, rings, watches, blood pressure cuffs, or similar wellness or fitness technology — is intended for informational, educational, wellness, and personal insight purposes only. You should not use Portico as a substitute for professional medical advice, diagnosis, or treatment.

You must not use Portico, or any data displayed within Portico, to make medical decisions. This includes decisions about medication, insulin dosing, treatment, diagnosis, interpretation of symptoms, or any other clinical judgment. Data from connected devices, including continuous glucose monitors, may be delayed, incomplete, smoothed, processed, or inaccurate. Always consult a qualified healthcare professional before making medical decisions, changing medications, starting or stopping treatment, or interpreting medical symptoms.

If you believe you may be experiencing a medical emergency, call emergency services immediately.

3. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. By using Portico, you represent that you meet this requirement and have the legal authority to agree to these Terms.

4. Your Account

You may need to create an account to use certain features of the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You agree to provide accurate information and to keep your account information up to date. You must notify us promptly if you believe your account has been compromised.

5. User Data and Privacy

6. Health Data and Sensitive Information

Portico treats data obtained from connected health and wellness devices, applications, and platforms — including but not limited to glucose readings, continuous glucose monitor (CGM) data, sleep and activity metrics, heart rate, heart rate variability, respiratory rate, body temperature, blood pressure, body composition, and similar measurements — as sensitive personal information.

We commit to the following:

  • We do not sell your health data. Portico does not sell, rent, or trade your health or wellness data to third parties.
  • We do not use your health data for advertising. Portico does not use your health or wellness data to serve advertisements, build advertising profiles, or share with advertising networks.
  • We use your health data only to provide the Service. This includes generating insights, scores, trends, and personalized recommendations for you, and improving the quality and accuracy of the Service, consistent with our Privacy Policy.
  • We protect your health data. We employ administrative, technical, and physical safeguards designed to protect your health data, as described on our Security page.

You may revoke access to your health data at any time by disconnecting third-party integrations within the Service or by revoking authorization through the third-party provider directly.

7. Third-Party Integrations

Portico may allow you to connect third-party services, applications, devices, or APIs. These integrations may include wellness, health, fitness, sleep, activity, glucose, blood pressure, or other data providers.

When you connect a third-party service, you authorize Portico to access and process data from that service as permitted by your authorization and our Privacy Policy.

Third-party services are not controlled by Portico. Your use of those services is governed by their own terms, privacy policies, API agreements, account settings, subscriptions, and data permissions. Portico is not responsible for the availability, accuracy, reliability, security, or practices of third-party services.

Data from third-party services may be delayed, incomplete, or inaccurate. Third-party services may modify, restrict, or discontinue access to their APIs at any time, which may affect Portico's functionality.

You may disconnect third-party integrations where supported by the Service or by the third-party provider.

8. User Responsibilities

You are responsible for how you use the Service and for any decisions you make based on information provided by Portico.

You agree not to:

  • Use the Service for unlawful, harmful, fraudulent, or abusive purposes.
  • Attempt to gain unauthorized access to Portico systems, user accounts, data, or third-party integrations.

You understand that early-stage features may produce inaccurate, incomplete, or unexpected results. You should independently verify important information before relying on it.

10. Insights, Scores, and Recommendations

Portico may generate insights, scores, summaries, trends, recommendations, or other outputs based on user-provided data, third-party data, device data, algorithms, models, or artificial intelligence systems.

These outputs are intended to help you better understand personal patterns and support wellness-oriented reflection. They may be incomplete, inaccurate, or not applicable to your individual circumstances.

Portico does not guarantee that any insight, score, recommendation, or prediction is accurate, complete, or suitable for any specific purpose. You should not rely on Portico's outputs to make medical or clinical decisions.

11. Intellectual Property

Portico and its content, software, design, trademarks, logos, models, algorithms, and related materials are owned by Portico or its licensors and are protected by applicable intellectual property laws.

Subject to these Terms, Portico grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own personal, non-commercial use.

You may not copy, modify, distribute, sell, lease, or create derivative works based on the Service unless expressly authorized by Portico.

12. Your Content and Data

You retain ownership of personal information, health information, wellness data, and other content that you provide to or authorize Portico to access.

You grant Portico permission to process your content and data as needed to provide, maintain, secure, improve, and personalize the Service, consistent with our Privacy Policy.

13. Feedback

If you provide feedback, suggestions, ideas, or other input about the Service, you grant Portico a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate such feedback into the Service without any obligation or compensation to you.

14. Service Availability

We may modify, suspend, or discontinue all or part of the Service at any time. We do not guarantee that the Service will be available, uninterrupted, secure, or error-free.

The Service may depend on third-party infrastructure, APIs, devices, data providers, and platforms. Changes or interruptions in those third-party services may affect Portico's functionality.

15. Termination

You may stop using Portico at any time. We may suspend or terminate your access to the Service if you violate these Terms, misuse the Service, create risk for Portico or other users, or if we are required to do so by law or third-party platform requirements.

Upon termination, certain provisions of these Terms will continue to apply, including provisions related to intellectual property, disclaimers, limitation of liability, and dispute resolution.

16. Disclaimers

The Service is provided on an "as is" and "as available" basis.

To the fullest extent permitted by law, Portico disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, security, and non-infringement.

Portico does not warrant that the Service will meet your requirements, produce accurate results, improve your health or wellness, prevent disease, or be free from errors or interruptions.

17. Limitation of Liability

To the fullest extent permitted by law, Portico and its owners, employees, contractors, advisors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or other intangible losses.

To the fullest extent permitted by law, Portico's aggregate liability for all claims arising out of or relating to the Service or these Terms will not exceed the amount you paid to Portico for use of the Service in the twelve months before the claim arose, or one hundred U.S. dollars ($100), whichever is greater.

18. Indemnification

You agree to indemnify and hold harmless Portico and its owners, employees, contractors, advisors, affiliates, and service providers from any claims, damages, liabilities, costs, or expenses arising from your use of the Service, your violation of these Terms, your misuse of data, or your violation of applicable law or third-party rights.

19. California Privacy Rights

If you are a California resident, you may have additional rights regarding your personal information under California law. These rights, and instructions on how to exercise them, are described in our Privacy Policy.

20. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify users, such as posting the updated Terms on our website or within the Service.

Your continued use of the Service after updated Terms become effective means you accept the updated Terms.

21. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to conflict of law principles, unless otherwise required by applicable law.

Any disputes arising out of or relating to these Terms or the Service that are not resolved informally will be brought exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts.
